2018 US Farm Bill Compliance
All Ganja Tree products are federally legal under the 2018 US Farm Bill, which defines hemp as cannabis containing no more than 0.3% Delta 9 THC by dry weight. Courts, federal agencies, and the DEA have confirmed that Delta 9 THC is the only relevant factor in determining hemp’s legal status—THCa and other cannabinoids are not considered.

This legal framework is supported by the 2018 Farm Bill (7 U.S.C. § 1639o), the DEA’s Interim Final Rule (Federal Register Vol. 85, No. 163, August 21, 2020), and key federal court decisions including AK Futures LLC v. Section 10114 of the 2018 US Farm Bill explicitly permits the interstate commerce of hemp. This law prohibits states, tribes, or federal agencies, including the DEA, from restricting or interfering with the transportation of legally produced hemp products. As long as THCa flower is grown and sold in compliance with the Farm Bill’s hemp classification it can be legally shipped across state lines.
